Personal Data Protection Law (KVKK) Information Text

AVASYA TEKNOLOJİ SANAYİ VE DIŞ TİCARET LİMİTED ŞİRKETİ respects your privacy and attaches importance to your data security. In this context, this document has been prepared to inform and enlighten you within the scope of the Law No. 6698 on the Protection of Personal Data ("the Law") and other relevant legislation.

In accordance with the Law No. 6698 on the Protection of Personal Data ("PDP Law"), your personal data, including any information that identifies or makes you identifiable and your special categories of personal data, may be processed by AVASYA TEKNOLOJİ LTD.ŞTİ as the data controller.

The processing of personal data refers to any operation performed on personal data, such as obtaining, recording, storing, preserving, modifying, reorganizing, disclosing, transferring, classifying, or preventing the use of such data.

Protecting your personal data is of vital importance to us. We want to assure you that we will take all necessary measures in this regard and will continue to be extremely transparent.

Purposes of Processing Personal Data

Your collected personal data may be processed for the purposes of ensuring the legal and commercial security of our Company and those with whom our Company has a business relationship, conducting satisfaction evaluation activities for our existing customers, organization and event management, conducting sales and purchasing processes, carrying out financial and accounting transactions, conducting internal audit processes, managing environmental protection and waste processes, conducting occupational health and safety activities, fulfilling notification obligations to relevant/authorized public institutions (Courts, Ministry of Environment and Urbanization, Ministry of Finance, Ministry of Labor and Social Security, Ministry of Interior, etc.), ensuring the implementation of our Company's human resources policies, and conducting information and physical security processes.

Transfer of Your Personal Data

Your data is processed for the purposes listed above, securely stored, and will absolutely not be shared with third parties except as required by law and with your explicit consent. It may be transferred to authorized public institutions/organizations in accordance with legal obligations arising from legislation such as the Turkish Commercial Code, Tax Procedure Law, Social Security Law, Labor Law, Occupational Safety and Health Law, and Environmental Management Regulation; to intermediary financial institutions for the purpose of assessing financial risks; to independent auditing firms for the purpose of conducting audit processes; to real estate appraisal firms for the purpose of conducting mortgage processes; to institutions providing intermediary/agency services in business travel, organization, and reward processes; to our business partners, shareholders, affiliated group companies, and local/international organizations from which we receive support in our business processes, within the framework of legal grounds and with your consent.

Method of Collecting Your Personal Data

Your personal data is collected by our Company through various channels and based on different legal grounds for the purpose of conducting our commercial activities. Within the scope of conducting commercial processes, this data is collected through written documents/forms such as customer introduction forms, supplier information forms, contact information forms, other commercial documents, payment information, valuable documents, candidate application forms, and notifications you make, verbally, in writing, or electronically. This data is collected entirely or partially automatically, or through non-automatic methods as part of any data recording system, and may also be obtained from sources outside of AVASYA TEKNOLOJİ LTD.ŞTİ, including our domestic/foreign subsidiaries, program partner institutions and organizations with whom we cooperate, official institutions, and other third parties.

Your Rights Listed in Article 11 of the Personal Data Protection Law

As data subjects, if you submit your requests regarding your rights to our Company using the methods set out below in this Privacy Notice, our Company will process your request free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if a fee is prescribed by the Personal Data Protection Board, the fee specified in the tariff determined by our Company will be charged.

a) To find out whether personal data is being processed,

b) Requesting information regarding the processing of personal data,

c) To learn the purpose of processing personal data and whether it is being used appropriately for that purpose.,

c) Knowing the third parties to whom personal data is transferred, whether domestically or internationally.,

d) The right to request the correction of personal data if it has been processed incompletely or incorrectly, and to request that the correction be notified to third parties to whom the personal data has been transferred.,

e) To request the deletion or destruction of personal data even if it has been processed in accordance with the Personal Data Protection Law and other relevant laws, when the reasons requiring its processing have ceased to exist, and to request that this action be notified to third parties to whom the personal data has been transferred.,

f) The right to object to a result that is detrimental to the individual, arising solely from the analysis of processed data by automated systems.,

g) You have the right to claim compensation for damages if you suffer harm as a result of the unlawful processing of your personal data.

Exercise of Data Subject's Rights

Data subjects may submit their requests regarding the rights listed in article (6.2.) of this Policy to the Company free of charge by filling out and signing the Application Form, which can be accessed via www.avasya.com.tr and its link, with information and documents that will identify their identity and by the methods specified below or other methods determined by the Personal Data Protection Board:

(i) After completing the application form, a signed copy must be delivered in person to the following address: Yukarı Dudullu Mahallesi Necip Fazıl Bulvarı Keresteciler Sitesi (KEYAP) D Blok No:60 Ümraniye İstanbul.,

(ii) After filling out the application form and signing it with your "secure electronic signature" within the scope of the Electronic Signature Law No. 5070, send the securely signed form to bilgi@avasya.com.tr via registered electronic mail.

(iii) With mobile signature,

(iv) Submitting the application form using the email address previously notified to the Company and registered in the Company's system.

(v) In order for third parties to submit applications on behalf of personal data owners, there must be a special power of attorney issued by the data owner through a notary public for the person who will submit the application.

**INFORMATION TEXT REGARDING THE PROCESSING OF PERSONAL DATA WITHIN THE SCOPE OF REFERENCE SHARING**

This Privacy Notice is provided by the data controller, acting in accordance with the Law No. 6698 on the Protection of Personal Data ("KVKK"), regarding personal data processed within the scope of reference sharing. Avasya Technology Prepared by.

Personal data may be transferred to service providers located domestically and/or internationally, within the scope of Articles 8 and 9 of the KVKK (Personal Data Protection Law), to the extent limited thereto.

5. Method and Legal Basis for Collecting Personal Data

Your personal data is provided by you in writing, via email, or through digital forms for the purpose of sharing references;

  • Your personal data is processed based on your explicit consent, in accordance with Article 5 of the KVKK (Turkish Personal Data Protection Law).

6. Personal Data Retention Period

Your personal data will be stored for the duration of the referral relationship or until your explicit consent is withdrawn.
Personal data shall be deleted, destroyed, or anonymized when the periods stipulated in the relevant legislation expire or when the purpose of processing ceases to exist.

7. Rights of the Data Subject

In accordance with Article 11 of the Personal Data Protection Law (KVKK);

  • To find out whether your personal data is being processed,

  • If it has been processed, request information about it.,

  • To learn the purpose of the processing and whether it is being used for its intended purpose.,
